Rental Agreement

  1. These General Terms and Conditions for Guest Accommodation apply to contracts for the rental of holiday apartments („Artist House“ as well as the „PANO Apartment“) for accommodation, as well as all additional services and deliveries provided by the provider for the guest. The services of the provider are exclusively based on these General Terms and Conditions. 
  2. The guest’s terms and conditions are only applicable if agreed upon in advance. Deviations from these conditions are only effective if explicitly confirmed in writing by the provider.
  3. The accommodation agreement is concluded when the provider confirms the guest’s booking request, either by phone or in writing via postal mail, email, and/or fax, thereby accepting the booking (acceptance of the offer). 
  4. The contracting parties are the provider and the guest. If a third party has made the reservation on behalf of the guest, they are jointly and severally liable with the guest to the provider for all obligations arising from this agreement, provided that the provider has received a corresponding statement from the third party.
  5. The guest is obligated to verify the accuracy of the booking confirmation. If the content of the booking confirmation deviates from the booking request, and the guest does not promptly raise objections, the content of the booking confirmation is considered as contractually agreed upon.
  6. Subletting or re-renting the provided holiday apartment, as well as its use for purposes other than residential, requires the prior written consent of the provider. 

II. Condition and Use of the Property

  1. The Property is provided in “as is” condition. The provider shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or fireplaces as applicable. The Provider shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
  2. Guest acknowledges that use of amenities such as fireplaces, rooftops, staircases, terraces, etc, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.

III. General Rights and Duties; House Rules

  1. The guest is obligated to handle the holiday apartment and its inventory carefully. The guest is required to adhere to the house rules. Quiet hours are observed from 10:00 PM to 7:00 AM, during which special consideration for fellow residents and neighbors is essential. TV and audio devices should be set at room volume. 
  2. During the rental period of the holiday apartment, the guest must keep windows and doors closed, locks the door, turn off lights, and switch off technical devices when leaving the apartment.
  3. The accommodation of pets of any kind in the holiday apartment is only allowed with the prior written consent of the provider. The provider may charge a reasonable additional fee for pet accommodation. If pets are accommodated without the prior consent of the provider, a cleaning fee of up to €200.00 (net) may be invoiced.
  4. Smoking is strictly prohibited in the holiday apartment. In case of violations, the provider may charge a cleaning fee of up to €500.00 (net) (In the Artist House), €200.00 (Pano Apartment, net) respectively. Smoking is only allowed outside the building. 
  5. Internet usage is permitted with the indication of the passport number, provided it does not violate legal regulations. Criminal activities (especially illegal downloads, page views) will be reported and prosecuted. The guest alone is liable for any illegal use of the internet.
  6. The installation and/or attachment of materials for decoration or similar purposes are not allowed in the holiday apartment. The guest is solely responsible for any installed and/or attached decoration or similar items and indemnifies the provider from claims by third parties. The guest is also obliged to compensate for damages caused by the installation and/or attachment of decoration or similar items. 
  7. The provider has the right to access the holiday apartment at any time, especially in case of imminent danger. The provider must consider the legitimate interests of the guest when exercising the right of access. The provider will inform the guest in advance about the exercise of the right of access unless it is unreasonable or impossible under the circumstances of the individual case.
  8. Guest agrees that no more than 22 persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. Exceptions can be made if confirmed in writing by the host.
  9. Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

IV. Liability; Statute of Limitations

  1. The provider is liable for their obligations under the contract. Liability is limited to intent and gross negligence of the provider to the extent that, according to legal provisions, they are not absolutely liable without limitation. In the event of disruptions or defects in the services provided by the provider, the provider will, upon knowledge or immediate complaint by the guest, strive to remedy the disruption or defect. The guest is obligated to contribute reasonably to the elimination of the disruption or defect and to minimize any potential damage. 
  2. Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Provider shall not be responsible or liable for any reason whatsoever. This explicitly applies to valuables that the guest stores and/or leaves in the holiday apartment. Guest hereby covenants and agrees to indemnify and hold harmless Provider t and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Provider harmless in all such cases.
  3. The guest is liable for all damages caused by themselves, their fellow travelers, or their visitors in the house of the holiday apartment, in the holiday apartment, and/or to the inventory of the holiday apartment, if attributable to their fault. The guest is recommended to have private liability insurance. The guest is obligated to report damages to the provider promptly. This particularly applies to damages that may also affect other apartments in the building (e.g., water damage, fire damage).
  4. Guest claims expire in six months unless the provider is liable for intent. Provider claims expire within the respective statutory period.

V. Default
If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

VI. RELEASE
Guest hereby waives and releases any claims against Provider, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.

VII. UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Provider, Provider will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Provider shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Provider shall have no further obligations or liabilities in any manner pertaining to this Agreement.


VIII. Cancellation Policy

Our strict cancellation policy aims to be fair to both guests and property owners by ensuring stability in managing bookings and protecting against last-minute cancellations. It encourages commitment while providing a consistent experience for all our guests. If you would like to cancel your booking please write us an E-Mail (rentals@pano-tinos.com) or contact us directly. For cancellations made 60 days before your arrival, we’ll refund you 50% of the total price. Please ensure that the full amount is paid within 14 days after your reservation in order to guarantee your reservation. Payment details for bookings and purchases

In order for us to finalise your booking, please ensure that the full amount is paid within 14 days after your reservation. Please note that only Invoice (Bank Transfer) and Apple Pay don’t apply a payment commission. 

Third party payment options

Please be aware that a payment commission and if needed a exchange rate is applied by the payment provider. The transaction fee is ranging from 2% to 5% for payment with PayPal, Stripe Connect, SEPA Direct Debit or Credit Card (Visa, Mastercard, Maestro, American Express). If you select any of these payment methods, we will collect the associated fee during the check-in process.

IX. Final Provisions 

  1. Guest agrees Changes or additions to this agreement, the acceptance of the offer, or these general terms and conditions shall be made in writing. Unilateral changes or additions by the guest are ineffective. 
  2. Place of performance and payment is Triantaros, Greece. Greek law exclusively governs this agreement.
  3. This agreement is applicable only for the personal use of the guest. Commercial use by third parties is expressly prohibited.
  4. If any of the foregoing provisions are or become invalid or void, this does not affect the validity of the remaining provisions. The ineffective provision is to be replaced by a provision that comes closest to the purpose of the provision to be replaced. Otherwise, the legal regulations apply.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an „AS IS“ and „AS AVAILABLE“ basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Greece without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
